These Terms of Use ("Terms") govern your access to and use of the Die Cast Club mobile application, website and related services ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Die Cast Club. By using the Service, you confirm that you meet this age requirement. If you are under 18, you confirm that you have parental or guardian consent.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at contact@diecastclub.app if you suspect unauthorised access.
You may delete your account at any time by contacting us. Upon deletion, your data will be permanently removed from our systems.
3. Use of the Service
You may use Die Cast Club only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or fraudulent purpose.
- Upload content that infringes third-party intellectual property rights.
- Attempt to gain unauthorised access to other users' accounts or our systems.
- Use automated tools to scrape, crawl or extract data from the Service.
- Harass, abuse or harm other users.
- Upload malicious code, viruses or any harmful content.
4. User Content
You are responsible for the content you add to the Service, including collection details, notes and images. You retain ownership of your content, but grant us a limited, non-exclusive, royalty-free licence to store and process it solely to operate and improve the Service.
We do not claim ownership of your die-cast collection data. We will never sell or share it with third parties for commercial purposes.
5. Intellectual Property
Die Cast Club, its logo, visual identity and software are protected by intellectual property laws. All rights not expressly granted are reserved.
Die Cast Club is an independent platform and is not affiliated with, endorsed by, or sponsored by Mattel, Inc., Hot Wheels, Matchbox, Auto World, Greenlight, Johnny Lightning, or any other die-cast manufacturer or brand. All brand names, trademarks and product names mentioned remain the property of their respective owners and are used for identification and reference purposes only.
6. Beta Disclaimer
The Service is currently in beta. This means features may change, be removed, or behave unexpectedly. We appreciate your patience and feedback. You can report issues at contact@diecastclub.app.
7. Service Availability
We aim to keep Die Cast Club available at all times, but as an independent service we cannot guarantee uninterrupted availability. We may perform maintenance, updates or changes without prior notice. We are not liable for any downtime or data unavailability.
8. Limitation of Liability
To the fullest extent permitted by law, Die Cast Club and its developer shall not be liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Service — including but not limited to loss of data, loss of collection information, or service interruptions.
The Service is provided "as is" without warranties of any kind, express or implied.
9. Account Termination
We reserve the right to suspend or terminate your account without notice if you violate these Terms or engage in conduct that we determine, at our sole discretion, to be harmful to the Service or other users. You may appeal a termination by contacting us at contact@diecastclub.app.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the new Terms. The "Last Updated" date at the top reflects the current version.
11. Governing Law
These Terms are governed by the laws of Portugal, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Portugal.
